YouTube Copyright claim against audio from VS free sample library?
So, there has been a music sample that has been included with VS in the Free Sample library since version X3 I believe. I am not talking about ScoreFitter or Triple Scoop stuff, just the free stuff the comes with VS under Samples.
Years ago, I used one of these samples in a youtube video, and now someone is claiming a copyright violation. Can this be a legit claim? Did Corel not procure the full rights to distribute these samples to buyers of VS? Do we as the buyers not actually have to right to use these free samples in our videos (which would mean they are not actually free samples)?

I believe that VS states that "files provided as samples in the program can be used for personal demonstrations, productions and presentations. No rights are granted for commercial reproduction or redistribution of any sample files." If you've monetized your YT video then there may be an issue.jungleexplorer wrote:Did Corel not procure the full rights to distribute these samples to buyers of VS?
Companies can misue YT's content ID system and falsely claim ownership of music, and sometimes YT's content ID system simply reports a false positive. SmartSound has a video on how to dispute copyright claims of SmartSound music on YouTube(https://www.youtube.com/watch?v=TiEpSF5uWtw). It would apply to other such claims.jungleexplorer wrote:Years ago, I used one of these samples in a youtube video, and now someone is claiming a copyright violation. Can this be a legit claim?

@tletter
I read the EULA for Corel VideoStudio. Of course, it is pages long is written in brain-melting legalese, but I found two vaguely comprehensible statements.
"as a user of Our Software You are free to use, modify and publish the Images or Clips, Font Output or Sample Content as follows: You may (i) incorporate any Images or Clips, Font Output or Sample Content into Your own original work and publish, display and distribute Your work in any media, provided You include a copyright notice in Your work reflecting on the copyright ownership of both You and Corel as follows: “Copyright (c) 20___ [Your name], Corel Corporation and its licensors. All rights reserved."
I did not know that I had to include this copyright notice. As far as commercial use, the only restriction I can find is this one, which I do not completely understand.
"use any of the Images or Clips which contain identifiable individuals or entities for any commercial purpose including, without limitation, in a manner which suggests their association with or endorsement of any product or service "
Nowhere in the EULA could I find anything that said that the content could not be used for commercial use except for the above statement, which if I understand it correctly is not a restriction of using their content for commercial use at all but only if I use it in conjunction with "Identifiable Individuals or entities", whatever the heck that means. None of the exclusions apply to my DIY videos on YouTube, which contain no identifiable entities and are not endorsing any product or service.
I really wish the FTC would make a law voiding all EULAs that are not written in clearly understandable common language. We need to outlaw legalese.

I doubt if including this copyright notice will prevent a YT Content ID claim but it might help should you decided to dispute the claim.jungleexplorer wrote: I did not know that I had to include this copyright notice.
As indicated, you can dispute the copyright claim in YT Creator. Alternatively, in YT Creator, if you decide not to dispute the claim, you can trim out segment in dispute, replace the song, or mute the song. If you select to mute the song, there is another option simply to mute the song only and keep the remainder of the sound (this option doesn't always work).
Perhaps you're unaware that YT provides much free copyright-free music that if you use it, you'll not encounter copyright claims on it.

I was curious about auto music feature which I use in YT videos. I check and I believe I am free to use since it comes with the license.
But to be in the safe side I do no monetize the content anyway.

YouTube is full of this stuff. A Royalty Free song today, is suddenly no longer RF. You just have to fight it (as above).
It's annoying, but it's happening more and more these days.

Yes, I am aware of the YT Free Audio Library. I have been uploading videos to YT since 2006, long before that existed. Just for reference, this was my very first version of VS, to give you an idea have how long I have been making videos with VS.

If this is the first copyright claim against you in 15 years, then you're doing very well.jungleexplorer wrote:I have been uploading videos to YT since 2006, long before that existed.

Re: YouTube Copyright claim against audio from VS free sample library?
Thanks. I do try hard to generate 100% of my own original content nowadays. The video in question was made a long time ago and honestly, is of no importance to my channel. My question here was more out of curiosity. I have already replaced the audio segment in question anyway.
