Yes, I never understand the likes of YouTube who seem to make a big deal about copyright infringement, but then give you an Upload button so you can upload other's works. :?

Ya guys im a bit confused. I heard there is a capture software that can do it , movavi.

Do you guys think any video capture software can be able to do this ? FOr instance can we use VS capture or i use hauppage video capture software.

The only part i wouldnt understand since we need to give our video capture a source , i usually insert a device in there like video camcorder or from TV but not sure how to link YOUTUBE to it.

This post is a reply to a number of others so not bothering with quote-credits.

http://www.keepvid.com is free and fabulous.

Short answer: Yes, for your own personal consumption and entertainment you can do anything you want with almost anything anywhere (real or cyber) BUT NOT for COMMERCIAL purposes.

>YouTube who seem to make a big deal about copyright infringement, >but then give you an Upload button so you can upload other's works.

Ummmm no, it's to upload YOUR OWN work.

I don't mean to denigrate, but you may be very young. You've *certainly* never suffered the FINANCIAL LOSS of someone taking your own creative work and selling it and not giving *you* a dime for your effort. You're certainly not a professional who *depends* on your own creative efforts for, ummm, food, rent, gas, and had someone 'steal your food/rent/gas money.'

I said almost anything because there are still caveats. Disney for instance is notorious for suing kiddie preschools that paint a mickey mouse on a wall.

Do you watch Big Brother / Survivor and notice that no one ever sings or even whistles? That's because they're not *allowed* to because CBS would have to pay a *royalty* for broadcasting the rendition of a copyrighted song, or get sued.

I received a *letter* from a lawyer because I used a particular 'two word phrase' in a web page that was his clients' registered trademark. (No I'm not gonna even state the two words here.) When I didn't do it within a week he phoned me and we talked for a while. I was asked to remove the phrase. I asked if I could edit/modify it and he said OK just that those two words in that order was not permitted. This lawyer guy makes his living tracking down instances of this phrase and asking people to remove it. Seems kinda silly *but* the *owner* of that phrase earns their entire *income* from it, and that's why they're so militant about it.

Another example. I'm doing a vid for a friend who teaches yoga/pilates classes. DVD needs background music. (In her classes she uses CD music, without paying royalty, which I cautioned her about, and she seemed a bit confused about all this too saying 'all exercise teachers do that.' But that's another topic. [sigh]) I don't personally do anything musical and don't have the $ to pay someone for anything. So I found ABox2 http://www.andyware.com/abox2/ which is a kind of synthesizer. Not really a synth but that's a good one-word definition. The software is free, the sample scripts are free, free meaning to have, use, and use whatever you create with it, and I made my own pseudo-raga soundtrack. Done. Perfect.

Bottom line - if you didn't create it, be safe-safer-safest, don't post(/publish) it. *If* you do something that somewhere down the line happens to earn you a ton of $, *and* you advertently or even inadvertently used someone else's creative are to create your own product, *then* you may very quickly and easily find youself sued for half or more of that ton of $.

(There's a lot more to it than those few paragraphs (fair use and such) but that's about it in a plain english nutshell.)

Have a :) day!

P.S. About that sig. I wrote the above post text. I 'created' it by putting a buncha words together in a certain order. So I sign it as 'mine.' Did you know that (within caveats of site policies) everything that *you* personally write on the net (or anywhere else for that matter) is your own copyrighted material? There was a major stinking brouhaha years ago over a yahoo policy that said that everything posted in groups.yahoo was *yahoo* copyright and property. (Don't know what the further result of that was only that a slew of ppl left for other forum providers.)

P.P.S. I found forum.corel.com policy posted at http://forum.corel.com/EN/viewtopic.php?p=171503 and scroll down to 'Copyright.' Most of it appears to be Corel CYA legalese but it is *very* adamant about not posting anything copyrighted to the corel forums.

Not necessarily true. Many people believe this is what is referred to as Fair Use under the U.S. Copyright Law. The following is an excerpt from a rather lengthy article about copyright infringement:
Fair use, sometimes referred to as the Fair Use Doctrine, does not necessarily grant the user the right to copy material which he or she has purchased. Fair use is generally reserved for use as a defense to a copyright infringement action.
More from this article:
According to Cary Sherman, the senior executive vice president and general counsel, the RIAA (Recording Industry Association of America) takes the position that any copying of music to CD that you perform on your computer is copyright infringement. Whether the source is digital or analog, whether the disc is a complete copy of a CD, tape, or LP that you own, or whether it is a compilation of songs from various sources that you own, the RIAA considers making such a copy to be a violation of the right of reproduction granted to copyright holders by the Copyright Act of 1976. They also recognize, however, that Section 1008 of the Audio Home Recording Act (AHRA) of 1992 gives those who perform such copying immunity from copyright infringement actions, provided that the copying is performed on a digital audio copying device as defined by the AHRA The RIAA's ultimate goal is to require CDR and CD-RW hardware manufacturers to look at the copy-protection bit on an audio disc and refuse to copy if that bit is set to "on."
Although this article was written about recording music, the same can be applied to video. Needless to say, the copyright laws are very confusing and easily misunderstood. If you are unsure, hire a lawyer.

Just to round things off, there was a very heated debate last year amongst the Web Board Staff regarding copyright issues.
We eventually managed to agree upon the following copyright issue guidelines in relation to postings on this Web Board.
