Is all music that comes with Video Studio royalty free?

Postby ianincrete on Tue May 22, 2012 4:39 am

I have made some video clips and uploaded them to YouTube. I only used music from Video Studio 4,and as I understand it, unless I purchase tracks I can only access music under the category "owned titles".
I assumed that this was royalty free music that came with the program, hence the name "owned titles". Anyway, YouTube has temporarily frozen my channel claiming that on one of my video clips I have used copyrighted music. The music I used was New Age -- Clear Vision -- Beyond. This piece Clear Vision does have an asterisk next to it and I have no idea what that asterisk means, but it still comes under the heading Owned Music. Also the piece YouTube claim I have used is called Joy of Life. Can anyone confirm that I have got this right and that all the music that appears under the Owned titles heading is free to use by owners of Video Studio?

Update. The music performing organisation that disputed my right to use the music that I put on my video clip has lifted its objection, so I guess that answers my question.

Yes, all the music is royality free, so long as you only use it for pesonal use, not for making a profit.

Out of mainly curiosity Graham, what would one have to do if he was creating a video for profit? I thought the included items in VSX5 were yours to use to create whatever you wish. :?:

I thought exactly the same thing. I *have* used the supplied music for commercial projects, as well as for numerous videos that I uploaded to YouTube and have "monetized." None of my videos have been flagged... which is not the same as saying that they earn much money.

Here's a commercial project where I used the included music extensively:

I thought that worked out pretty well for about three days notice, starting with a blank sheet of paper. And that included having to get approvals from the project manager.

If we can't use the included music for commercial (and YouTube) videos, then that's a big deal for me. I use it all the time.

I've been going by this for SmartSound music: http://www.smartsound.com/products/licenseinfo.html

EDIT: I was reading the EULA about Images and Clips owned by "Us" or licensed from 3rd-parties where you are suppose to include a specific copyright notice in your work. I didn't read about any restriction for personal use only.

The requirements may be different for your country.

Can't find the one I was thinking about, but this one shows up in a search
viewtopic.php?f=1&t=25578&hilit=copyright%2C+music%2C+commercial+use

Just in case my search doesn't show up properly....

From the VS manual:

Sample files
Files provided as samples on the program CD can be used for personal demonstrations, productions and
presentations. No rights are granted for commercial reproduction or redistribution of any sample files.

If you are talking about the SmartSound music, this is from their website:

The music is royalty-free. You will NOT need to pay us any additional fees to use the SmartSound music. The music is copyrighted and the original composer retains his copyright. That just means that you are allowed to use the music, but you do not own it. Under the license agreement, you can use SmartSound music to accompany video, multimedia and web projects. You may sell projects which include SmartSound music. You cannot make and sell a music library using SmartSound music.

Whew! Yeah, that works for me. I don't use the sample photos and video clips for anything, although the countdown clip might work for a future video. The explanation on the music is perfect and satisfies my concerns about the music rights.
